On the Website you can purchase: photography archives, framed printed pictures, books, DVDs and video footage archives (raw materials) (collectively the "Products").  

The Products can be ordered in accordance with the information you provided in the payment page as appears it in the checkout form (the "Payment Page") .The payment shall be made by credit card or by purchasing credit in advance via subscription to the Website.

 

You are obliged to provide true, accurate, current and complete information in the Payment Page and, at the same time, undertake to notify Albatross of any changes in such information and/or in the use of the Products.

 

You acknowledge that the price at which the Products are offered to you is set in accordance with the information you provided to Albatross in the Payment Page. You are also obliged to act in accordance with the purpose indicated in the Payment Page, according to which the Products have been offered to you at a given price.  

 

You authorize Albatross to conduct any and all investigations as may be required for the authentication and/ or verification of the information you provided in the Payment Page.

 

Any use exceeding or deviating from the purposes and/ or the information provided in the Payment Page infringes Albatross's rights and shall be prosecuted and punished to the fullest extent permitted by law.

 

You acknowledge and agree that payments made by credit card shall be irrevocable, unless otherwise permitted by law.

 

In order to purchase a subscription to the Website (the "Subscription"), please contact Albatross through the contact details listed in the Website.

 

The Subscription enables you to open a prepaid account. Once the Subscription has been purchased you will be provided with a Subscription number which will enable you to access your account for a period of one year and to purchase Products on the Website by directly charging your prepaid account.

 

 You are strictly forbidden to allow any third parties to use your Subscription, including but not limited to, Subscription number, account password and / or any other detail that may enable an unauthorized use and/ or purchase of Products through your Subscription. Each and every activity on the Subscription and/or transaction on the prepaid account are under the sole responsibility of its official owner.

 

All Products purchased on the Website are non returnable, unless otherwise provided by law.

 

Albatross does not guarantee in any way, that illustrations portrayed in the Website catalog will be completely identical to the purchased framed pictures shipped to your address.

 

Purchased Products will be shipped and delivered to the address you provided in the Payment Page. Albatross will not be liable for any damages that may occur due to wrong or incomplete information in the Payment Page.   

 

You undertake to use the files strictly in accordance with the information provided in the Payment Page.

 

You undertake to destroy the files at the end of the use. You agree to hold harmless and indemnify Albatross from damages arising from or in any way related to your failure to destroy the files or to avoid any use of it that may exceed what stated in the Payment Page.

 

DVD movies are for personal use only, unless specifically purchased for public use in accordance with the information you provided in the Payment Page.

 

All intellectual property rights of the Products belong entirely and exclusively to Albatross. Without derogating from the above, you are strictly forbidden to reproduce, copy, photograph, distribute and/or make any commercial use of the Products or part of them.

 

Albatross shall not be deemed responsible for any damage arising from an illegitimate use of the Products or disclosure of your Subscription information to third parties.

 

By purchasing the Products you agree to be the sole legal responsible for the use of the Products and exonerate Albatross from any responsibility with respect to such use.

 

 

In no case Albatross shall be deemed liable for any direct, indirect, incidental,  special, or consequential damages arising from your use of the Website or the purchase of the Products including, but not limited to, the interruption of the access to the Website, loss of profits or loss of data. By purchasing a Subscription, you automatically and irrevocably waive any claims against Albatross related to possible damages and/or losses you may incur by using the Website.

 

In no case Albatross shall be deemed liable for any direct or indirect loss and/or damage relating to the use of the Website, including for loss of profits, directly and/or indirectly, or damages to your computer. The laws of the State of Israel shall govern this Terms of Use and your use of the Website. You expressly agree that the exclusive jurisdiction for any claim or dispute with Albatross or relating in any way to your use of the Website resides in the courts of the district of Tel- Aviv, in the State of Israel.
